Im trying to pay my mortgage off faster after being sold out from one main financial after i had to leave my job. Now im good and trying to pay extra on my principle each month. I have the payment taken off my card every month with a extra $12 paid that i was told woukd automatically go towards my principle. I also paid $2000 extra with a money order and on the payment stub marked everything out other that extea principle and even highlighted extra principle and wrote on the paystub that my payment is already auto drafted every month and the $2000 is to go to principle ONLY. WELL what do you know they applied it to regular payments and said i was 3 months ahead but only $150 went to the principle because all the rest was insurance and interest. I called 2 times. First time i told them i was tape recording the call because im constantly being told different things and they refused to talk to me even though they say they are recording for training and safety purposes . Then she tells me that no they dont apply extra to principle that i have to call and tell them apparantly every month since i have extra being sent to them every month. Then i ask to be transferred to someone who can answer my questions about why now it says my march payment was being charged 2 seperate $18 fees saying one is a late payment fee and the other is another fee. how is that when im paid up until march according to yall. When i was transferred to somebody that could answer my questions i was conveniently cut off. I was told that any extra funds goes to the unapplied funds because they dont know where to put the money. but as i told her i sent $2000 and it says 1400 was in unapplied fund then it says $0 and you applied the money to regular payments so i have to pay all that interest first so what you are saying doesnt even make sense. You better keep track of all payments made to these ppl and call them frequently to make sure they are doing what they are suppose to be doing. Apparantly they dont want you to be up to date because then they start charging you extra stuff on your mortgage bill and then you cant talk to anyone to get a answer because they conveniently cut you off. Sorry excuse for a business and if these funds are not applied correctly im consulting a lawyer.

Recently gave my keys for cash to bayview. Now there is a sign at the front door. Saying
Warning. This property was found unsecured.. Making it look as thought I abandoned my home. Which I didn't. Its defamation of my character. It looks like they are trying to devalue this home by not taking care of the property. The grass hasn't been mowed and the electric turned off meaning the sump pump hasn't run and the basement will be flooded. I have been scammed
Cash for keys - not what they say.
I was told you would get half upfront and half when the property sold.
Guess what? We got half upfront and then denied the other half after we left and the “investor” was blamed.
My loan was sold to Bay View. I made one payment and now for months, my account manager will not call me back to take the next two payments. When I finally got him to answer the phone, I told him I had been trying to pay, why wouldn't he call me back, etc. He laughed and hung up on me. Now I'm trying to get a hold of his boss Dominque. No answer there either. I'm wondering if they are doing this on purpose to take my home. I'm almost afraid to give them the money now. I got a letter saying they needed my deed. Why wouldn't they have that from B of A? This is fishy at best. Could you please tell me if this is a legitimate company and if I have any recourse.
Thank you,
Lucinda Whitacre
Back in April I requested mortgage relief in the form of a request to start a Short Sale. In a letter dated May 26th Bayview sent me a letter that stated, ". your request for a short sale or purchase contract has been received. In that letter, there is not any prescribed "due by" date affixed. In fact, no where in this letter is a definitive timeline laid out for completing any action other than getting you the paperwork to execute the start of the process to conduct a short sale.
I have provided Bayview, twice, copies of the Listing Agreement with Keller-Williams Realty. Just today, I was told that the house was in foreclosure effective June 1st. I never received any notification from Bayview or their contracted attorney on this issue. Not even a phone call or email.
In fact, their letter only says that I need to start returning paperwork no later than an implied June 26th.
I just finished a 40 minute phone call with Mr. Robert Tyer, who stated that he was the senior man in charge there at Bayview. He has stated that once the house goes to "sale" there is nothing that Bayview can do because the process is: I request short sale approval, I find a buyer, sell the house, send in the offer, Bayview evaluates the offer and approves or denies. If yes, then done deal; if no, then start over with other options.
Nowhere in there letter has any of that been spelled out?
Nowhere in their letter is there a discussion of timelines?
Nowhere on their website is that explained, at all or in the level of detail that I just laid out?
Bottom line is that it is not.
We never received a notice of foreclosure from the attorney who represent Bayview nor did we receive any communication from Bayview stating that there was a more definitive timeline to follow or any particular deadlines to adhere to.
We have spent a little over $7, 000 getting the house ready to sell - new carpeting, cleaning, painting, repairs, etc. We were supposed to have an open house this weekend but since the house went to "foreclosure sale" we can't do that. I had to cash in my retirement fund to just do that much.
At the first foreclosure sale, on June 2nd, the starting "bid" was $442K and no one took the bait. I'm trying to sell the house at $495, 000, per the Listing Agreement and what we worked out with our Realtor.
It seems to me that despite what Mr. Tyer said, Bayview can stop the foreclosure and allow me to sell the house at the amount we're trying to sell it at and make sure that Bayview gets their money and that we can walk away from the home without any further delays. If a definitive timeline for actions or the correct manner that the process needed to be played out had been delivered to us, we wouldn't be here going through this. Since Bayview was more concerned about Bayview getting their money, I would think that some part of this would make sense to Bayview superiors.
I am requesting that you make contact with your retained attorney, Mr. C. Richard Epps, to stop the forclosure sale and allow us to put the house back on the market so that we can sell it at the higher value and allow everyone to get paid and allow us to walk away without any outstanding issues.
This makes the best possible sense for all parties.
I should also advise you that I will be contacting the Prince William County Attorney's Office and the State's Attorney General's Office on this matter to see if there are any legal means that will allow us to sell that home and pay off our responsibilities in a manner that is equitable to all parties.
Should you desire to call me, I can still be reached at [protected] after working hours.

Learn moreMy Citimortgage loan was turned over to Bayview Loan Servicing. I was due a $5, 000 HAMP incentive in in the sixth year (2015) of a loan remodification agreement I had completed with Citimortgage. Bayview loan Servicing withdrew the $5, 000 incentive, saying I had not fulfilled the terms of the trial period. The trial period was over in December, 2009.
Monthly payments have been made by Bayview Loan Servicing directly drafting from my checking account since March, 2014. I have not missed any payments through any action on my part, or lack of available funds for withdrawal before or since tht date.
However, Bayview Loan Service stopped drafting payments in May, 2015 on their own, without notification to me or my attorney. I did not notice this until September, 2015. I called on September 8, 2015 to ask why loan payments had not been drafted. I was told it had to do with a double payment Bayview drafted from my checking account in April 2015.
(On April 2, 2015 I noticed Bayview Loan Servicing had not made a withdrawal for the loan payment due April 1, 2015. I called Bayview Loan Servicing and was told I had to authorize the payment by telephone. Why, I do not know. I authorized the payment by telephone. Later I saw on my bank statement taht in addition to telephone authorized draft, Bayview Loan Servicing had drafted a second loan payment on the same day. I called to request the overpayment be refunded, and I received the refund April 9, 2015 by wire transfer.)
During my September 8, 2015 phone call I was also told I would have to authorize a payment by telephone for $3, 504.80 immediately to avoid jeopardizing my loan status. I authorized the payment as requested at that time.
It was never made clear to me why Bayview Loan Servicing stopped drafting from my checking account. The drafts started again in October, 2015, the month following my telephone call and $3, 504.80 payment, and have continued uninterrupted since then.
Bayview Loan Service has not responded to written requests about this matter.
Read full review of Bayview Loan Servicing and 1 comment Update by dprint Jun 29, 2017 1:40 pm EDTThere is strength in numbers. If we could find others who have the same experience with Bayview we should be able to get a regulatory agency interested in investigating them. If you have any ideas about how to find others like ourselves let me know. I'd sure like to pursue the matter. I've tried on my own, but Bayview has stonewalled and state and federal agencies have passed on doing anything on the pretext this is civil matter which I would need to hire an attorney to pursue. I don't know any attorneys who would be willing to take on such a small case on a contingency basis. I can't afford legal fees, especially since they would almost surely far exceed any damages I might be able to collect.
A class action legal suit or complaint to a regulatory agency is another matter. At least I would think so.
Bayview Loan Servicing automatically withdraws mortgage payment from my checking account each month. One month they stopped making withdrawals, after I found they had made two withdrawals in the same month and demanded they refund the extra payment. After several months I called and they said I was delinquent and demanded an immediate phone payment which I did. They then continued making the automatic withdrawals.
Several months later they sent a letter withdrawing a $5, 000 credit to my principal balance, saying that I was in violation of terms of the mortgage loan modification agreement I had made when the mortgage was with Citimortgage. They refuse to reinstate the credit even though I had done nothing to stop payments to them.

I was also set up for automatic payment and received a letter stating that our May and June payments haven't been made. Once i called to find out what was going on, I found out that they had my account and another account that wasn't mind set up for automatic payments each month. So 2 payment was supposed to come out each month, after doing more research and more calling bayview I found out that the account that someone else's account was attached to mine and those payments were declining. But the bad part about it is that some of our payments from the other acct were made at the same time that my payments were made, but bayview had the nerve to say that our payments were behind. My problem with that was that the was getting 2 payments towards our acct for 2 months, how are we possibly behind. Once I checked my credit report I realized that they had been reporting that my payments were 30 days late. Bayview is a rip off and something has to be done about them.

We have had several life altering events over the past three years that lead to bankruptcy in January 2016. With the Federal Bankruptcy Court's approval, we held Bayview and the homes we own out of the bankruptcy. We live in one of the homes we own on the business property. The loan did not include the eight mobile homes on the property. We faxed the loan modification for financial hardship to the lawyer in Ohio in Sept, 2016. That office admits that they received the documents. Bayview admitted that they received the documents. We were communicating with what we thought was a representative for Bayview, that asked for proof of my surgery with another hardship letter. But, he left Bayview without any notice to us about the request for a loan modification. We believe that the representatives that we were contacting for a solution to our loan modification were instead collection people hired to push the people for money and then sale the property for gain back to Bayview. We have reason to believe that the request for this modification was not presented to Bayview. The first sheriff's sale was vacated. But Bayview did have a sheriff's sale on Feb 2017, where they sold the home to themselves for $90, 000 less that our loan. Now we have a broker that is pushing us around and saying that the mobile homes are part of the foreclosure. We have titles for all of these homes.

By doing this, they made it easier for my ex to keep the home. I am meeting with my attorney today to take them to court.
If I wasn't relevant when the modification was done, they should have gone and refinanced the mortgage without me. I have called and contacted members of Bayview without success.. At this time I have a case number and hope to keep on contacting them until we have a solution. I would never recommend Bayview Loan service to anyone. Keep a detailed record of your mortgage payments. I made an extra principal payment online along with my monthly mortgage payment. When i look online to keep track of their work to be sure its posted correctly, I discover that they
do not post payments to the accounts. They only send a confirmation receipt showing you made a payment. Nothing is broken out appropriately. I'm keeping track of my payments because of their sloppy non transparent accounting.
I suspect my balance and their balance will be off. Then the burden of proof is on me, which is fine with me. I am warning others who make payments to this loan servicing company. Don't be foolish and assume your best interest is being served. In this day and age of cyber transparency, there is absolutely no excuse or reason I cannot obtain a history of how my payments were applied to my loan, showing a running balance.
Everyone that is having problems with this company; Please file against Bayview with: Consumer Finance Protection Bureau at [protected] . You can also go to the website. They don't have any actual proof they lawfully purchased any mortgages from anyone who had any right to sell them in the first place. They were set up as a arm of JP Morgan Chase to push off the liability of all the fraud that has been committed by the the big banks when they stole notes and mortgages from Trusts and then claimed them as their own. Requested duplicate forms, then lied and said they did not receive our modification ppwk in time. We have sent and requested response to 26 emails. They foreclosed on our home and are now going to be evicted. They dual-tracked out home. 1/31 I called to check the status of the loan modification on 1/31 (Due and submitted 12/31) only to be told that our loan was still pending review and due to the end of the year deadline, they were taking 45-60 day review. Unbeknownst to us (we never received any information/documentation) our loan had been referred to an attorney on 1/25. PRIOR to our loan modification being reviewed. On 2/9 we received a certified letter from an attorney that our loan was being accelerated and foreclosed upon (sale date 3/7). Yet, we had still never been given a reply/decision on our loan modification. I called Bayview multiple times with no reply. I made my first of 3 complaints to the CFPB on 2/9. On 2/10, Bayview responded to CFPB confirming the receipt of the complaint. I continued to call/email Bayview without EVER receiving a reply. On 2/24, we received 4 letters; 3 dated 2/9 stating our loan modification was denied because our requested loan modification documents had not been received by the due date. The last letter was confirming receipt of our CFPB complaint. 3/7 our home was foreclosed on and sold (back to the VA). Myself, with out HUD counselor has tried to contact Bayview. To no available. Now, we are receiving attorney letters stating they will be taking possession of the home. One of our 4 children was diagnosed with a terminal illness which has been the main source of our hardship. All we have asked was to have a temporary modification to equal the initial lender agreement. For months our payments were sent, kept (more than 10 days), not applied to the loan, not acknowledged, and refused. We then received a letter stating that any payments sent would be refused. WE are . freaking out. I called the office AGAIN Friday (4/21), left a message for our 'Asset Mgr' David Iannucci (who we have NEVER talked to). Of course, to no avail.

Without the fees and penalties Bayview added to the loan the $155, 000 would be much lower. We have had some life changing events in the last several years that forced us to go bankrupt in 2016. But we held Bayview out of the bankruptcy so we had a home. We sent all of the request papers for financial hardship, but did not hear back from Bayview. We called the Ohio lawyer that they were using and asked if Bayview had recieved the documents. The assured us that Bay view did recieve the documents. I had major back surgery on October 10, 2016 that will take at least a year to fully recover from. That meant that I could not work the two jobs I had been working. We began calling Bayview, but it is hard to get anyone to talk to. We finally got a direct phone number to what was a loan modification representative. He asked for more documents. Then when he left Bayview, we were not notified. We finally found someone else from Bayview to work with us in December. He told us what else they needed, and he would pull the equity information and we would talk again after the first of the year. He lead us to believe that he would at least ask Bayview for the modification. Then he stopped taking my calls. I contacted another person in loan modifications that said they would call us back. This did not happen, and Bayview never sent a letter of rejection. Bayview foreclosed Feb 6, 2017, and bought the loan back at the sheriff sale at 1/2 of what our loan was. I will not stop looking into Bayview and their financial standards until I can join a class action or start a new class action lawsuit myself. Canton, Ohio

They did the same thing to me and my children. I spent 2 years in mental anguish trying to save my house. sending them my last 5100 dollars only to find out it was being sold on the courthouse steps as I drove "home" for lunch. No one in my family would even believe me that this was happening to me. They thought I was on drugs or something. Like not taking care of my children and spending the money. like this kind of thing doesn't really happen to people. How are you now?

I have an attorney involved representing me, but am continually being stalled by their tactics requesting additional information, missing forms, new information requests, request for the same information over and over. All to delay the process and when the costs are too high to save my home, force a foreclosure. This has been going on for close to a year now. I am keeping my statement here short and somewhat vague, as I do not wish to have them deny me if they get any concrete information relating to my statement here. I do plan on complaining to my congressman, the BBB, and have advised my attorney that I desire to pursue further legal action. A class action suit against them would not hurt my feelings at all.

After contacting B of A directly, we were scammed out of $5000, which we can not recoup. We then contacted B of A AGAIN and were contacted by a lawyer from Roosevelt Law, paid them $4100 for our loan modification. The "modification" was done thru Bayview Loan Servicing. These people are terrible! We paid our 3 month trial modification, then were approved. However, they have a CA address, which is were correspondence is being sent to ?. We have repeatedly asked to have our address corrected, especially since this is a "legal document". They have failed to do so! Now they are saying we have not paid any mortgage payments. We submitted complaints to BBB, CFPB, and DOJ. This has caused so much emotional and mental distress. We have no idea what is going on. When we got a response from CFPD, Bayview denied all of this. They are now unwilling to help. This "mortgage" company needs to be shut down, fined, and ALL fees, "late" mortgage payments, etc removed from our balance and our mortgage needs to be placed with a reputable company!

Bayview got a hold of this property after a bankruptcy dismissal. We signed a deed in Lieu with this company because we were told better than foreclosure. Received a 1099 to pay taxes on #15, 000. We never owed them anything. They are saying it is for financing charges? They still have an open account because house has not been sold.

Learn moreWe were with Kellner mortgage when we first got our loan in 2006. They then sold our mortgage to Countrywide and they sold it to BOA and BOA sold it to Bayview Loan Servicing. While we were with BOA, they set us up on a repayment plan paying $777.09 for 4 months while our mortgage was only $464.82/month. Before we could finish our last payment on the repayment plan, they sold our loan to Bayview Loan Servicing. Bayview stated that those payments from BOA did not follow so we were behind. They are now telling us that we are 20 payments behind and unless we come up with a little over $6000 up front and they'll spread the rest of our payments out, then we are facing foreclosure. They told us that our file was referred to their legal team to start the foreclosure process. Bayview also sent us a letter stating that we were not qualified for the HAMP modification because; "PLEASE CONTACT OUR CUSTOMER SERVICE". This is exactly what the letter read and I still have this letter in my possession. I then called HAMP and they told me that this is not a reason to deny us. HAMP stated that Bayview were to provide us with a legitimate reason and why we were denied and that they were sending our file to their escalation department. I am awaiting a response from HAMP as well as Bayview on our status; but at this moment, I feel BOA and Bayview has done my husband and I complete injustice. We are ready to file suit against them. The sooner, the better.
Read full review of Bayview Loan Servicing and 1 comment Hide full review rodney tames Baltimore, US 1 complaint 85 comments rodney tames of Baltimore, US Jan 26, 2015 12:08 pm ESTIf you have all documentation from your BOA loan you should be able to prove you had paid 3 of the 4 payments of $774 to BOA and if they bought the loan they should be honoring it. The reality is they wont honor and they will waste your time and money. The key to dealing with a sub prime lender like Bayview is to be organized and have copies of EVRYTHING.
The sad reality is Bayview is going to make your life miserable and fee you to death. That is their game. The scary foreclosure club is always over your head. That being said, there are a few ways to fight them.
1) Hire a competent real estate attorney that has had experience with sub prime lenders. This may help get it straightened out but you will pay an attorney a fair amount of money as Bayview will not really be swayed by a legal letter. (they get lots of them!).
2) Fight fire with fire. Quit giving them any money until they get their crap together. This is a game of chicken and not for the faint hearted. Remember they want your money not your house. I assume that your credit may not be great (they will trash it anyways even if it is). In most states it takes a good 12 or more months to really get your moved out of your house. Again, they don't want your house (unless you have lots of equity in it) they want money with late fees, paperwork fees, it is Tuesday fees, etc. If you play this right you will get their attention and possibly even a better deal.
3) Your big stick is bankruptcy. Don't be afraid of this financial tool. It is the most misunderstood financial tool among average folks. Big business wants to keep it that way. Bayview has probably already trashed your credit or will by saying you are late on those 20 payments. Once your credit is trashed bankruptcy is a solid option. Once your meet with a bankruptcy attorney, you stop paying all bills other than gas, water, electricity (vital things). Everything else is effectively stopped and no one can contact you regarding your debt. You will meet with your attornies several times and eventually meet with a federal trustee who will decide the outcome. If you as a couple makes 75k or less you can discharge everything if you want. It just goes away and they cant hassle you again, and Bayview will most likey get screwed big time. The other hidden gem is at the trustee hearing he/she may be able to negotiate a settlement for you to keep your house if you want to. Again, you probably get a better deal. Or start fresh and clean and dump the house on Bayview. Your credit will start coming back up almost immediately. It really will.
I am sorry that you are being hassled by these crooks. But remember they want your money and will scare you with foreclosure to get it. Fight back and smash them in the face.
